Terms of Service

Last updated: October 15, 2026

These Terms of Service ("Terms") apply to every order placed on www.hushclasp.com (the "Store"). Please read them before you order. By placing an order, you accept them. They do not take away any right you have under the consumer law of the place where you live.

1. Who we are

The Store is operated by Kiliane SOW, individual entrepreneur (entrepreneur individuel) registered in France, trading as Hushclasp.

  • SIREN: 943 349 688
  • Email: support@hushclasp.com

In these Terms, "we", "us" and "our" mean Kiliane SOW trading as Hushclasp. "You" means the customer.

2. Where we sell

We ship to the United States, Australia and New Zealand only. We do not accept orders for delivery to any other country. If an order for another country gets through, we cancel it and refund you in full.

Hushclasp is a business: we sell in trade. The Store is intended for consumers buying for personal use. You must be at least 18 years old, or have the permission of a parent or guardian, to place an order. We may refuse or cancel an order that appears fraudulent; in that case we refund you in full.

3. Products

We sell hair accessories: The Clasp (magnetic hair clasp), The Flat Claw, The Silk Scrunchie, The Thick Ties, The Detangler and The Vent Brush.

We describe each product as accurately as we can: material, size, colour and what it is for. Colours may look slightly different depending on your screen.
Some lifestyle images on the Store were created or edited with the help of artificial intelligence. Product shape, colour and size shown in product photos correspond to the item we ship.

Our products are not toys and are not intended for children. They contain small parts and/or magnets: keep them out of reach of young children. The Clasp closes with small magnets: if a magnet is swallowed, seek medical help immediately. Keep The Clasp away from pacemakers and other implanted medical devices.

4. Prices and offers

  • Prices are shown and charged in US dollars (USD), not in Australian or New Zealand dollars. If your card is in another currency, your bank converts the amount and may charge conversion fees.
  • Delivery to the United States is free on orders of $25 or more and costs $4.95 below that. Delivery costs are set out in our Shipping Policy and are always shown at checkout, with the total price, before you pay.
  • Import duties and taxes: see section 6 of our Shipping Policy.
  • Bundles and promotions (for example "Buy 2, get 1 free") are valid while displayed on the Store and cannot be applied after the order is placed.
  • Crossed-out prices: the crossed-out price next to a pack of The Clasp, The Flat Claw or The Silk Scrunchie is the price of the same number of items bought one by one at our single-item price ($14.95 for The Clasp and The Flat Claw, $14.90 for The Silk Scrunchie).
  • If a price is obviously wrong because of a technical error, we contact you before shipping and you may cancel with a full refund.

5. How the contract is formed

  1. You choose your products and pack, then go to checkout.
  2. You check your order summary, the total price and the delivery address, and you can correct them.
  3. You click the payment button.
  4. We send you an order confirmation by email. The contract is formed when we send this confirmation.

Keep this email: it is your copy of the contract. We will also send you a copy of these Terms by email on request.

6. Payment

Payment is due when you place the order. Accepted payment methods are shown at checkout. Payments are processed securely by our payment providers; we never see or store your full card number. There is no subscription and no recurring charge.

7. Delivery

Delivery times, tracking, import duties and what happens if a parcel is late or lost are explained in our Shipping Policy, which forms part of these Terms.

8. Changing your mind (30 days)

You can change your mind and return your order within 30 days of delivery, without giving a reason. How to do it, who pays return postage and when you are refunded: see our Refund Policy.

9. Your legal rights if a product is faulty

Our 30-day policy is in addition to, and does not replace or limit, your legal rights:

  • Australia: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
  • New Zealand: nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, which cannot be excluded. Our products must be of acceptable quality, fit for their purpose, match their description, and be delivered to you within the agreed time or, if none was agreed, within a reasonable time.
  • United States: you have the rights given by the consumer protection laws of your state, including any implied warranties (such as the implied warranty of merchantability) that cannot be excluded.

To use these rights, write to support@hushclasp.com with your order number and a photo. We repair, replace or refund at no cost to you, as the law provides.

We do not offer any commercial warranty beyond these legal rights and our 30-day return policy.

10. Liability

Nothing in these Terms limits or excludes our liability where the law does not allow it, in particular for death or personal injury caused by our negligence, for fraud, or for your rights under the Australian Consumer Law, the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986, or the consumer laws of your state.

Subject to that, we are not responsible for:

  • losses caused by using a product contrary to its instructions or its normal use;
  • delays or failures caused by events beyond our reasonable control (for example natural disasters, strikes, carrier or customs disruptions), provided we tell you promptly and offer a refund if delivery becomes impossible.

11. Reviews

If you send us a review, it must reflect your own genuine experience with the product.

12. Intellectual property

The Hushclasp name, logo, texts, photos, videos and design of the Store belong to us or are used with permission. You may not copy or reuse them without our written consent.

13. Personal data

How we use your data is explained in our Privacy Policy.

14. Complaints and applicable law

Contact us first. Most problems are solved quickly by email: support@hushclasp.com, or through our contact page. We answer within 2 business days.

If we cannot agree, you keep every remedy available under the law of the place where you live, including the right to go to the courts of the place where you live. In Australia, you can contact the consumer protection agency of your state or territory. In New Zealand, you can contact the Commerce Commission (www.comcom.govt.nz) or apply to the Disputes Tribunal. In the United States, you can contact your state's consumer protection office or the Federal Trade Commission (reportfraud.ftc.gov).

Your consumer contract with us is governed by the consumer protection laws of the place where you live, and nothing in these Terms deprives you of their protection. These Terms do not contain any arbitration clause and do not limit your right to go to court or to take part in a class action.

15. Changes to these Terms

We may update these Terms. The version that applies to your order is the one published on the Store on the day you placed it.
